These terms are the agreement between you and Poolr LLC for use of Poolr. They cover what we provide, what we do not, and what each of us is responsible for. Please read section 6 in particular, because it explains something a lot of people assume wrongly about services like this one.
Poolr is operated by Poolr LLC, a Pennsylvania limited liability company (“Poolr”, “we”, “us”). By creating an account, joining a pool or otherwise using the service, you agree to these terms. If you do not agree, do not use Poolr.
Our Privacy Policy explains what we do with your personal information and forms part of this agreement.
You must be at least 18 years old to create an account or to join a pool. By using Poolr you confirm that you are.
We apply one age rule to everything, including free pools, because a commissioner can add an entry fee to an existing pool at any time. We do not verify anyone’s age, and we rely on you telling us the truth.
You must also be legally able to enter into a contract, and not barred from using the service under the laws that apply to you.
Poolr is software for organising and scoring sports pools. We provide the tools: picks, automatic scoring from published results, standings, awards, records of who a commissioner says has paid, and the arithmetic for splitting a prize pool.
Poolr is not a bookmaker, a betting operator, a casino, an escrow service, a payment processor for your pool, or a party to any pool. We do not set odds, accept wagers, hold stakes or pay out winnings.
Whoever creates a pool is its commissioner. Commissioners set the rules, the deadline behaviour, any entry fee, how a prize pool is divided, and who may join. They can correct results, adjust picks and remove members inside their own pool.
A commissioner is responsible for running their pool honestly and for collecting and distributing any money involved. If you join a pool, you are trusting its commissioner, not us. Disputes about picks, results, rules or money are between the members of a pool and their commissioner, and Poolr is not a party to them and will not arbitrate them.
A commissioner may record an entry fee and a prize split in Poolr so that the app can show who has paid and what each winner is owed.
Money never passes through Poolr. We do not collect, hold, transfer or pay out entry fees or winnings, and we take no share of any pot. Every payment between members and their commissioner happens directly between them, by whatever method they choose. What you see in the app is a record the commissioner keeps, not a transaction we processed.
The laws on pools, contests and gambling differ from place to place, and can turn on details such as whether an entry fee is charged and what the prize is. You are responsible for making sure your pool is lawful where you and your members live. We do not give legal advice and nothing in the app is a statement that your pool is legal.
Do not use Poolr for anything that is unlawful where you are. If we believe a pool is being used unlawfully, we may suspend or remove it.
Creating a pool is free. A pool stays free while its active membership is at or under the free member limit shown in the app. Once it grows past that limit, the pool is locked to read only until its commissioner pays a one time hosting fee. The amount is shown before you pay.
The fee is a single payment for that pool. It is not a subscription, it does not renew, and it is not charged per member. Payment is handled by Stripe, and their terms apply to the payment itself.
Refunds: we will refund the hosting fee within 3 days of payment, provided the pool has not yet locked its first pick. After either of those points the fee is final. To ask for a refund, email us before the deadline. This does not affect any refund right you have under law that cannot be waived.
You agree not to:
You keep ownership of what you put into Poolr, such as your team names, announcements and profile picture. You give us permission to store, copy and display it as far as we need to in order to run the service for you and the other members of your pools.
You are responsible for what you post, and you confirm you have the right to post it. We may remove content that breaks these terms.
Poolr, its name, logo, design and software belong to Poolr LLC. These terms give you permission to use the service, and nothing more. Do not copy, modify, reverse engineer or create derivative works from it.
League, team and player names and marks belong to their respective owners. Poolr is not affiliated with, endorsed by, or sponsored by any sports league, team or organisation.
We are actively building Poolr, so features may be added, changed or removed. We aim to keep the service running but we do not promise it will be uninterrupted or error free, and we may take it down for maintenance.
Scores and schedules come from third party data sources. Those sources are sometimes late, incomplete or wrong, and we do not guarantee their accuracy. A commissioner can correct a result inside their own pool, and doing so is their call, not ours.
You may stop using Poolr and delete your account at any time. We may suspend or terminate an account or a pool if these terms are broken, if we are required to by law, or if we reasonably believe it is necessary to protect other users or the service.
If we terminate your account without cause, we will refund any hosting fee you paid for a pool that is still within its current season. Sections that by their nature should survive termination will do so, including sections 6, 10, 13, 14, 15 and 16.
Poolr is provided “as is” and “as available”. To the fullest extent the law allows, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non infringement.
We do not warrant that the service will meet your requirements, that results or standings will be free of error, or that any pool run on Poolr is lawful where you are.
To the fullest extent the law allows, Poolr LLC is not liable for indirect, incidental, special, consequential or punitive damages, nor for lost profits, lost data, or lost entry fees or winnings.
Our total liability for any claim relating to the service is limited to the greater of the amount you paid us in the twelve months before the claim, or one hundred United States dollars.
In particular, because money never passes through Poolr, we are not liable for entry fees a member does not pay, for a prize a commissioner does not distribute, or for any other dispute about money in a pool.
Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you.
You agree to indemnify and hold Poolr LLC harmless from claims, losses and reasonable legal costs arising from your use of the service, your breach of these terms, or any pool you run or take part in, including any claim that a pool was unlawful.
These terms are governed by the laws of the Commonwealth of Pennsylvania, without regard to its conflict of laws rules.
Talk to us first. If something goes wrong, email privacy@poolrpicks.com and give us 30 days to sort it out. Most problems end there.
If we cannot resolve it, any dispute will be brought in the state or federal courts located in Erie County, Pennsylvania, and we each consent to the jurisdiction of those courts. Either of us may instead bring a qualifying claim in small claims court.
We may update these terms. If we do, we will change the effective date at the top, and if the change is significant we will tell you in the app or by email before it takes effect. Continuing to use Poolr after a change means you accept the updated terms.
